Joseph's Adventures in Communism and College



Previously, I talked about my great-grandfather, Rabbi Moshe Eliezer Shapiro, and the late Prof. Louis Feldman of blessed memory as examples of antifragile Judaism, people who created Jewish lives for themselves under unplanned circumstances. In the world of antifragility, what looks good on a day-to-day basis is not necessarily what will work in the long run because what makes such systems look good is precisely what can bring it down in a once-in-a-generation disaster. I would like to return to this issue of antifragility and its implications for Judaism.

Critical to Jewish survival has been its ability to adapt to situations to which our faith, as envisioned by previous generations, was not designed to handle. The most extreme example of this was the rabbis after the destruction of the Second Temple, who reimagined Judaism without its central sacrificial cult and without the majority of the biblical commandments. This requires us to rethink who the heroes of Jewish history are from those who lived ideal religious lives under ideal circumstances to those who lived non-ideal lives precisely because their circumstances made such ideals impossible. 

The biblical Isaac is someone held up by the rabbis as a person who was able to live his life in Israel in purity without sin. As Rashi teaches, Jacob wanted to live that life but God sent him the calamity of Joseph. Joseph lived his life in Egypt as a slave, a prisoner, and finally as viceroy. Joseph had to carry on for all those years under the assumption that he had been cast out by his brothers and that there was no future for him as part of the Children of Israel. It is Joseph who not only physically saved his family but also made it possible for Israel to spiritually survive 210 years in Egypt. It is not for nothing that, every Friday night, Jews bless their sons to be like Joseph's children, Menashe and Ephraim, who grew up in the court of Egypt. Similarly, we have the later models of Daniel and Esther in the courts of Babylon and Persia, cut off from Israel and with no hope of being able to return. In Esther's case, she even intermarried.

Let us be clear as to what the challenge is here. Ignore the strawman argument that Egypt or Persia (or America) is different. This is easily countered by "we, the faithful, do not change." This strawman argument, though, covers an alternative utterly devasting attack of not that the world has changed but that you have changed. The moment a person wakes up and sees themselves as different and irreparably cut-off from their former selves with no hope of returning, then casting off one's former beliefs and practices becomes natural. One realizes that the hard act of changing has already happened and now it is only a matter of accepting the reality of the situation. In fact, the very tenacity that one held on beforehand, insisting that the new circumstances did not matter, will come to work in favor of giving in as it will make the break, once it happens, that much more obvious.  

Imagine trying to train a twentieth-century version of Joseph. It is the year 1900 and your newborn student lives in Czarist Russia. You have him until he is seventeen. In 1917 the Bolsheviks are going to take over and put an end to open Jewish observance. Your Joseph will have to live out his life without the support of a Jewish community and his observance will be compromised at best. What can you give him that will allow him to maintain a Jewish identity in his own mind and pass it along to his own Menashe and Ephraim to the extent that when he dies in 1991, with the fall of the Soviet Union, it will be as a Jew surrounded by a Jewish family?

The members of my family who came closest to living out this story were my maternal great-grandparents, Yitzchok Isaac and Feigy Schwartz. (Note that both my father’s father and my mother’s grandfather were named Yitzchok Isaac.) They survived the Holocaust only to go back home to a Soviet-controlled Hungary where they raised three daughters. As a teenager, my grandmother took advantage of the 1956 Hungarian Revolution to flee to the United States because there weren't any good Jewish men to marry. My great-grandfather passed away when I was a kid. I only knew him as an old man sitting in a dark corner of my grandmother's house, who did not speak English. Frankly, he scared me. (I confessed this as an adult to my father and he laughed telling me that I had no idea what a kind man he was.) If I could talk to him now, I would want to ask him how he found it in himself to raise a Jewish family with no Jewish community to rely upon and offer hope for a future.  

The 20th century gave us Communism, the Holocaust, and ultimately the destruction of Eastern European Jewish life. Jews in 1900 could not have prepared for this but, at the end of the day, all of their efforts to build up Judaism that were not centered around the United States and Israel were going to be little better than futile. I have no idea what this century will bring. That being said, is it not unreasonable, for those in the United States to construct an educational system on the assumption (whether or not you are Haredi and oppose college on principle) that students are going to go college for four years without meaningful Jewish support. You have kids from the age of 5 until they are 18. What can you teach that will allow a student to go to college and, regardless of the compromises that they might make there, they will have a Jewish identity that will persevere to the extent that they will seek to rejoin the Jewish community afterward and raise a Jewish family? Anything that is not clearly focused on this goal needs to be cast aside as a waste of time and a distraction.  

Whether we are dealing with the extremes of Communism and the Holocaust or the mundane challenges of college, I assume that a successful pedagogical strategy will try to build a strong Jewish identity backed by theology and a deep emotional attachment to Judaism. Jewish identity here means a knowledge of ritual practice as well as a sense of Jewish history. Theology means having open and honest discussions about God and not simply assuming that kids believe in God just because they are ritually observant. Developing an emotional attachment to Judaism means getting away from threats of hellfire and, instead, making sure that Jewish practice is both joyful and meaningful. This is not to be confused with being fun and entertaining as that will have little staying power. A Passover Seder is not very entertaining but it can be effective if conducted by adults who understand what the Seder is about and are not simply going through the motions. Discussions about identity and theology should best be conducted over a Shabbos cholent or during shabbatons/summer camp along with plenty of singing. 

Take away a Jewish community and a person with a strong Jewish identity will continue as a Jew because, at a fundamental level, they see Judaism as essential to who they are and not merely a culture they grew up in or a set of practices they used to follow. To abandon Judaism would become unthinkable as almost a form of suicide. For all intents and purposes, it would be a different person living that non-Jewish lifestyle. A strong identity can allow a person a continuous sense of self that is not broken by anything that happens on the outside. Defending a Jewish identity requires a theology in the sense that our Joseph should be able to answer the Wicked Son's question of "what is this service to you." Having a theology is useful precisely when there is no community to give meaning to your identity. One thinks of the example of Maimonides, who lived for several years as a Muslim and developed the first list of Jewish doctrines. You could have a person living their entire lives without ever being able to practice Judaism. They are still Jewish because they are able to believe certain things even if it is only in their heads. Finally, all the arguments in the world are not going to keep an intelligent person Jewish if they do not already love Judaism. If a person sees Judaism as a burden to be carried in the hope of getting into heaven, a college campus will provide plenty of intellectual justifications for discarding that burden.  

If we accept this model of Jewish education then it raises some difficult questions about Haredi education. Frankly, Talmud, at least how it is conventionally taught, becomes a kind of "spork," in theory good for a lot of things but fails to do any one thing particularly well and is better replaced by alternatives. For example, there are better ways to teach halakha. It is even more difficult to use Talmud to teach theology. Talmud, with its jumping across generations, lacks a clear narrative in contrast to the Bible. The Talmud's strongest selling point would be that it can build Jewish identity by allowing students to develop a sense that they are a continuation of the rabbis with their discussions. Note, though, that while this form of Jewish identity, is well suited for people operating within a Yeshiva system, it is likely to crack precisely when that community is no more. Our Joseph, whether in college or under Communism, is not going to be a rabbi. That option is closed. If our Joseph is to remain Jewish it will be precisely because his sense of himself as a Jew transcends his being a rabbi. 

I readily acknowledge that the Haredi system is better at producing Jewishly knowledgable and fervent kids than the Modern Orthodox schools. Clearly, if the question was keeping kids religious tomorrow, Haredim would win easily. But the lesson of antifragility is that you have to prepare for the extreme. Breaking Haredi kids should be relatively easy. There is no need to argue with them. Take away their tzitzit and yarmulkas; clip their peyos and let them see themselves in the mirror. No need to force them to eat non-kosher, just let them feed themselves from a dining room not designed for kosher eating and make their own compromises. The fact that these compromises may be quite defensible will not change the fact that they are compromises. Once you create a break with their past selves, the rest should follow easily. 

Remember that Haredi kids have not been trained to imagine themselves living outside a Haredi community. On the contrary, they have been conditioned to make that imaginative leap impossible. Thus, the moment you take them away from their community, they will likely see themselves as different people. This is not the case with Modern Orthodox kids, who have identities distinct from their Judaism. This might make them less fervent and more likely to abandon the faith on a day-to-day basis. It also might allow them a stronger sense of continuity even under difficult circumstances. As long as mental continuity exists then Jewish identity stands a fighting chance.

Taxation is Theft and the Pharmacist Dilemna



I generally like John Stossel but here, in his discussion with Ben Shapiro, he utterly fails to provide a coherent libertarian response to the question of what taxes are theft. He argues that taxes that provide national defense are necessary so, therefore, such taxes do not count as theft. To be clear, my objection is not to whether we need a tax-payer funded army as opposed to perhaps a private army paid for by life insurance companies for the protection of their dues-paying members. I readily acknowledge, particularly for the near future, that there may not be a better solution and we will have to live with some government programs, like an army, for all of its imperfections.

The problem with Stossel's response is that it turns the question of taxation into which taxes do you support and which do you oppose. This means that we libertarians have no principled objection to Bernie Sanders' type free health care and college. Clearly, those on the hard left believe that these policies would benefit society and it is hardly obvious that they are wrong. Worse, there is a clear benefit to being part of the larger package of the government. Hence, even the taxes for policies you oppose do not hold up as theft. Part of the package deal of living in a democracy is that you will end up having to pay taxes to fund policies that you actively oppose.

When we talk about whether taxation is theft, it is important to distinguish between whether taxation is theft and whether or not we should still tax people even if it was theft. Implicit in this is that fact that the claim that taxation is theft does not refute the concept of taxes. It is theft to take a single penny from a billionaire to buy guns so that soldiers would be able to fight off an invading Nazi army. As much of an anarchist as I may be, I am willing to put aside my scruples for such national emergencies. In both my religion and in my politics, I am guided by the Talmudic principle of "you shall live by them." My beliefs are not a suicide pact and all of my values may be subordinated to saving human lives. None of this changes the fact that taxation is theft. It just means that some kinds of theft are a mitzvah. As a Burkean, I accept that life has a tragic dimension to it and not everything breaks down into neat and clean principles; sometimes we have to get our hands dirty and become morally tainted.

A useful example to consider is the classic moral dilemma of robbing a pharmacist. Your mother is deathly ill. You go to the pharmacist and he has the only available bottle of medication that can save your mother but he will only sell it to you for $10,000. You do not have that kind of money so you plead with him and try to negotiate for a lower price but to no avail. He refuses to sell you the medicine and walks away leaving the medicine on the counter. Do you grab the medicine and make a run for it? I bring up this example not to take a side in the question of what is more important, letting your mother die or stealing, but to note that a critical point for even beginning to discuss this question is that, regardless of whether you should or should not do it, taking the medicine is stealing. It is not necessarily the case that stealing is wrong in all cases and, under certain circumstances, might be necessary and perhaps commendable. That being said, theft remains generally wrong. Even if you are thirsty, you cannot steal a coke from the pharmacist.

For me, the purpose of proclaiming that taxation is theft at every opportunity is not that we should not have taxes but that we should radically limit the number of issues that we would seriously consider funding through taxes. If you would not be willing, for the sake of a cause, to put a gun to someone's head and tell them to hand over their wallet or else you will splatter their brains on the pavement then you cannot use government even if that would mean the defeat of your cause. As much as I love Shakespeare, I am not willing to threaten to kill people in order to fund the teaching of Shakespeare in schools. If that means that Shakespeare is no longer studied and we are left with a much poorer culture then so be it. I may be a hypothetical thief but there are some thefts that really are outside the pale.

The Antinomian Implications of Gedolim: Are You Willing to Put Your Traif Where Your Mouth Is?


A prominent feature of Haredi society today is the belief in the infallibility of their rabbinic leaders, the Gedolim. These Gedolim are supposed to be miracle workers, whose knowledge supersedes that of ordinary mortals like you and me. In essence, Haredim took halakhic Judaism, premised on textual authority, and replaced it with charismatic authority in which religious leaders are assumed to receive some kind of divine revelation. There was a good sociological reason for this. It was charismatic authority, ironically, that was best suited to defend religion against modernity's challenge to religious authority. As a simple Jew, why should I not listen to the Conservative rabbi, who says that it is ok to drive to a synagogue on Shabbat if I live far away and would otherwise not be able to celebrate Shabbat as part of a Jewish community? Even to make a halakhic argument against driving on Shabbat will be counter-productive. You might fail to convince me and I will, therefore, go drive. Even if you succeed this time, you will have implicitly conceded to me the premise that, in the absence of any religious authority with coercive powers, I am my own ultimate halakhic authority and am free to rule however I wish.

The Haredi solution was to declare that there was a body of men whose opinions, a priori, cannot be challenged. It is not just that these Gedolim are really smart and have good arguments for their positions. I like to think that I am a smart person too so tomorrow I will come back with even better arguments, at least to my mind. The Gedolim must not just be smarter than me, their intelligence must be of such a different kind that I could never imagine being in the right against them.

A large part of the Haredi success has been due to its ability to claim for itself the mandate of being the defenders of Jewish Law; are not Haredim the strictest in terms of religious observance? This is in large part due to the Haredi world's clear lines of authority. But as with any Faustian bargain, the price to be paid is high. Part of what of I find fascinating about the Haredi use of Gedolim is that their practical use in the defense of ritual orthodoxy does not change the fundamentally antinomian implications of charismatic authority and may come to serve as the perfect cover to destroy halakha.

For those who would defend the absolute authority of Gedolim and also claim to be loyal to halakha, I propose a thought experiment. Imagine that the Gedolim were to call you into a secret room and order you to eat the ultimate traif sandwich. Would you listen to the Gedolim or would you, in your "arrogance," dare to place your limited understanding that there is such a thing as kosher over their wisdom and refuse to eat it? Some simple Jew, who recalls that, according to Leviticus, a pig is not kosher as well as stories about Maccabean martyrs, is going to think he has the right to lecture the Gedolim about kosher and accuse them of not following the Torah? Does he not know that without the Gedolim we would all be lost like sheep without a shepherd, prey to Reform and Conservative Judaism with their women rabbis?

Note that there may be a very good reason for the Gedolim to want you to eat traif. Eating traif is a useful signaling device as to who really is loyal to  Haredi Judaism. A person who is not willing to listen to the Gedolim and eat traif, but prefers to follow his own understanding of Judaism today might turn around tomorrow and not accept that Judaism opposes women rabbis. Alternatively, a failure to eat traif on the command of the Gedolim might endanger Judaism by opening up the possibility that some Jews might, at some future point, question the rulings of the Gedolim regarding kosher and refuse to eat in the homes of other Haredi Jews. An Orthodox Judaism in which members are not united in eating each other's food is liable to fall apart. Such a divided community would lack the moral standing to defy the liberal denominations on women rabbis. Clearly, it is better to eat a pig than to accept women rabbis. (Or at least that is the impression I get from the OU.) We can even add "who made men and women in their places" in addition to the traditional blessing for traif: "who permits the forbidden." Only a godless heretic could be against saying more blessings when we all know that a single amen has the power to change worlds.

One might take support from the story in Rosh HaShanah in which R. Gamliel forced R. Joshuah to violate the day of Yom Kippur as he calculated it. Allowing there to be two Jewish calendars risked destroying the religion and needed to be stopped at all costs, even violating the religious consciousness of R. Joshuah. (Perhaps the Dead Sea Sect supported women rabbis in addition to their solar calendar.)  I should note a distinction between R. Joshua violating his Yom Kippur and our traif case. R. Joshuah had every reason to believe that R. Gamliel was acting in good halakhic faith, adhering to the principle that one is not allowed to travel with a stick and a money belt on Yom Kippur. R. Gamliel might be wrong in his astronomical calculations, but he made his mistake as part of a legitimate halakhic process based upon textual analysis and not charismatic authority. In our traif case, the Gedolim want you to eat what they acknowledge to be a pig on the assumption that they are not bound by any text-based halakhic process. In fact, their goal is to destroy the practice of text-based halakha as a heresy that would allow any person with a Judaica library to become their own halakhic authority.

A Judaism in which every person is free to do what is right in their own eyes as long as they can point to a Jewish source cannot be called Haredi. A Judaism in which it might be ok to eat traif, even in secret antinomian rituals, cannot be called Orthodox. Take your pick, text or charismatic authority. I vote for there to be such a thing called halakha even if that puts me in charge of my own religion.

Haredi Theology Making Itself Irrelevant: Some Thoughts on Gates of Emunah


As a Maimonidean, I do not just disagree with Haredi theology, I stopped, long ago, taking it seriously. Haredi theology can be divided into two schools; there are those Haredim who are blatantly idolatrous (Chabad) and then there are those, who really do not have any theology at all beyond a vague sense of tribal supremacy. God must exist and have given us the Torah, because if he did not, how can we turn our noses up and talk condescendingly about the "goyim."

A good example of this is Gates of Emunah - The Principles of Faith, based on the lectures of the late Rabbi Shimshon Dovid Pincus. I was struck by his opening chapter as to the extent that, for a work that is supposedly about theology, how little the writer cares about actually making arguments. For Pincus, the arguments for Judaism are so obvious that they do not even need to be stated. Even a child should be able to figure them out. If you disagree with this then it can only be because you are spiritually tainted and maliciously desire to reject God. This leads to a counter-intuitive argument, but one that is distinctively Haredi: "Someone who studies the property laws of maseches Bava Basra is fulfilling the mitzvah of emunah because in this way he draws himself closer to Hashem. He becomes connected to Hashem, so he thereby attains emunah." (pg. 9) For Pincus, faith has nothing to do with abstract arguments or even clearly stating principles to believe in. Study tort law from the Talmud, something that has nothing to do with God and you will have somehow believed; in what, it is not at all clear. Of course, this line of thinking raises an interesting question; why should anyone, after reading this passage, bother to continue reading this book? You should immediately throw away the book as a waste of time and open a Gemara.

To be clear, I do not reject all arguments from subjective experience. I think that there is something to C. S. Lewis style apologetics where we believe in God because our world makes more sense with God in it. It is important to realize, though, that, for Lewis, this argument comes out of a dark and despairing place that recognizes that, at a sheer intellectual level, the argument against God is quite powerful. For example, in the novel the Silver Chair, when the Lady of the Green Kirtle tries to seduce the children into believing that there is no world above, no sun, and not even an Aslan, Puddlglum counters that it is amazing that they managed to somehow make up a better world to such an extent that he would rather die searching for their "childish fake" world above than continue to live in her "real" one.

Part of the irony here is that Puddlglum's argument gains its strength from the fact that logically the witch is right and that he seriously contemplates what it might mean to live in her Aslan-less world. The utter horror at this prospect suggests the faint possibility that perhaps there is something she has missed. It is important to keep in mind, though, that Puddlglum does not refute the witch. On the contrary, it is acknowledged that she has the better argument and that the evidence lies on her side.
It is sometimes easy to forget because we think of Lewis as a children's writer, how really dark Lewis could get. For Pincus to follow Lewis' path, would be to make his readers uncomfortable with themselves, which is the one thing his theology cannot allow him to do. His book exists not to convince his readers about what the right answers might be, but to reassure them that they already have the right answers and need to think no more about them.

While we usually refute arguments through contradictions or reductio ad absurdum, the proper approach here is to note that Pincus' theology makes itself irrelevant. I am reminded of Allan Bloom's argument against cultural relativism in his Closing of the American Mind. Imagine an idealistic college freshman sitting down for his first English class taught by a committed post-modernist relativist. If the teacher is effective at giving over the principles of post-modernism, our student should immediately abandon his English classes, go to business school and never open a book again. I would add that any intellectually honest relativist English teacher should immediately insist that their students go to business school, end the class and resign from their teaching post. At a practical level, one has to ask, why have elite universities been so ineffective at keeping their students out of the business world or keeping their schools from being turned into profit centers with students as mere customers? Perhaps students and administrators are learning the lessons of relativism a little too well and are better post-modernists than the professors running English departments.

If this Emunah book was honest, instead of Pincus' face, the cover should have a sign saying "do not waste your money buying this book or your time reading it." As with secular relativism, the consequences of taking this theology seriously go beyond financial bankruptcy for lecturers and book publishers. At the same time that Pincus claims that we do not need to study theology, he also laments the superficial nature of the observance of many Orthodox Jews. He blames secular influence but would it not make more sense to say that these Orthodox Jews have been influenced by the "theology" of writers like Pincus and reached the proper conclusions? Whether God really exists, there really is no reason to seriously think about it. Much better to study Talmudic business law, become a rich lawyer and a de-facto atheist. You should just practice Judaism because you like the community and being part of the chosen people helps your self-esteem. If you think about it, the commitments of Jewish rituals are not necessarily much greater than the cost most people pay to be part of a specific club. (Think of what students go through to enter fraternities.)

You might think that I am reading too deeply into things and that Pincus cannot really mean what I think he does. Except that, at the end of the first part of the book, Pincus openly comes out and informs us:

         If we were to speak of the ABCs of being a ben Torah, then the 'A' would be to grasp this point            of, "This is my God and I will glorify him." Someone who grasps this point no longer has to                study the Rambam's Moreh Nevuchim or the Sha'ar HaYichud section of Chovos HaLevavos.

Clearly, the only reason to study modern works of Jewish theology would be to understand the classics as the modern works might present material in a more accessible fashion. If there is no reason to read the classics, why should anyone waste their time with modern works like that of Pincus?

Amy Chua: Possibly a Better Mother than Historian




Yale Law professor Amy Chua has recently been making headlines with her book Battle Hymn of the Tiger Mother, a misleading excerpt of which was published in the Wall Street Journal, about the "superiority" of Asian mothers, who do not let their children attend sleepovers, insult their children for failing to achieve academic excellence and make them practice music for hours on end. I found the whole thing amusing as this was not the first time Amy Chua has crossed my radar. Several years ago I had a lot of fun posting on her book Day of Empire and her utter incompetency as a historian. I think it is worthwhile to note that, from what I can tell, Chua does not appear to force her daughters to spend hours on end attempting to critically analyze primary and secondary sources, something that Chua is clearly unable to do and has written a book proving it.

Unlike her many critics, I will not question Chua's abilities as a mother and keep my knocking of her to the realm of history. Actually, I think there is a lot to be said for Chua's style of parenting. While not nearly as intense as what Chua describes, my parents were much stricter with me than most of my peer's parents were with them and I benefited from that. The point that Chua makes that struck the strongest chord with me was:

What Chinese parents understand is that nothing is fun until you're good at it. To get good at anything you have to work, and children on their own never want to work, which is why it is crucial to override their preferences. This often requires fortitude on the part of the parents because the child will resist; things are always hardest at the beginning, which is where Western parents tend to give up. But if done properly, the Chinese strategy produces a virtuous circle. Tenacious practice, practice, practice is crucial for excellence; rote repetition is underrated in America. Once a child starts to excel at something—whether it's math, piano, pitching or ballet—he or she gets praise, admiration and satisfaction. This builds confidence and makes the once not-fun activity fun. This in turn makes it easier for the parent to get the child to work even more.

This is a key argument used by educational theorist Daniel Willingham in his book Why Don't Students Like School. Willingham argues for the value of homework and repetitive drilling, particularly in the early grades. The idea is that learning in any given field requires a certain baseline of knowledge and a set of skills. You either have it or you do not and there is no fun easy way to get it. The only option is to just drill it in. Once a child has gained the necessary skills then the real education can begin and yes it can be fun.

I am good with history and enjoy it because I made myself memorize loads of historical facts as a kid and therefore have a baseline knowledge and skills now to read even really difficult works of history. In contrast, I never really developed the necessary skills in reading Talmud. My high school yeshiva education was therefore hell as I floated along accomplishing nothing. Today I have a mental block when it comes to the topic and avoid it. Perhaps I needed a Tiger Mother to drill me into a Talmudic scholar.

A Heart for Women Rabbis




Recently the issue of women rabbis in Orthodox Judaism has come to the fore. Rabbi Avi Weiss gave the title of Rabba to Sara Hurwitz. He was utterly condemned for this by the Haredi Agudah. He managed to reach a compromise with the Rabbinical Council of America (RCA) that Ms. Hurwitz would only be given the title of maharat. Furthermore the RCA declared that under no uncertain terms would they be willing to except women rabbis. Yeshiva University's Rav Hershel Schachter has gone so far as to argue, based on the Avnei Nezer, that ordaining women as rabbis would constitute handing them power and that this is forbidden. Furthermore, since the ordination of women forms a central plank in the Reform and Conservative movements to "misrepresent" Judaism, one must be willing to "give one's life" into order to oppose it. I am not here to argue, one way or another, for or against women's ordination. I honestly do not know how I, if given the power to choose for Orthodoxy, would rule. I do not think the issue is as simple as freeing women from the "tyranny" of patriarchy. Women would pay a price for having the possibility of being ordained and would be rendered less capable of working outside the system. Also I do not think that Orthodoxy is prepared structurally for women rabbis. With this being noted, I find myself concerned about the RCA's response. I am not bothered by the fact that they came out against female ordination. What does concern me, though, is the process through which this decision was reached and what this might say about the mindsets of those in charge even of the Modern Orthodox community.

Dr. Haym Soloveitchik, in his essay "Religious Law and Change: the Medieval Ashkenazic Example," famously argued that the French Tosafists bent over backwards to justify committing suicide in situations of religious coercion in order to defend the legitimacy of those Jews who committed suicide and even murdered their own children during the Crusader attacks of 1096. The Tosafists turned to non-legal material from the Talmud, a story of four-hundred girls and four-hundred boys who throw themselves overboard and drowned in order to avoid being taken to Rome and sold into sexual slavery. The Tosafists recognized that they could not possibly say that those Jews who died during the Crusades were anything less than holy martyrs, who died sanctifying God's name. God forbid anyone should say that these people were murderers and suicides. Such a prospect would be unthinkable, so the discussion of suicide in cases of religious coercion, from the beginning becomes one of how do we justify it. Similarly, in my own experience when talking to Orthodox Jews about what constitutes idolatry and whether certain Haredi rabbis have crossed that line by endorsing the claims of Kupat Ha'ir, the response that I immediately get from most people is "these are holy people so what they are doing must be good." This is of course circular reasoning. If someone engages in idolatry then, by definition they are not holy no matter how pious or learned they might be. King Ahab, according to the Talmud, was a great Torah scholar, who honored the twenty-two letters Hebrew letters in which the Torah is written; that does not change the fact that he was an idolater and one of the great villains of the Bible. Simple cognitive dissonance sets in and the only conversation that is possible is how what Kupat Ha'ir does is okay or that the rabbis are not really behind it. The alternatives are simply too unfathomable for them
 Whatever is decided about women's ordination, I want the rabbis to come to the table with the understanding that claims that women cannot or should not wield political or religious power are non-options. I do not care if you can make an intellectually plausible case using a nineteenth century book on Jewish law, written by a Hasidic Rebbe. You should be finding every plausible way to justify having women in positions of authority. I do not care if you have to do like the Mormons and claim that God has now given a special command that we end our earlier discrimination. The alternatives should simply be too unfathomable.

Conservative Judaism Has Gedolim

  One is used to Haredim speaking about their leaders, both past and present, otherwise known as the Gedolim, in ways that imply veneration if not downright idolatry, complete with acronyms or the titles of their books. Modern Orthodox Judaism has their particular thing with Rav Yosef B. Soloveitchik, the Rav. This is certainly not something that one would expect from the more liberal Jewish denominations. Joel L. Kraemer, in his biography of Maimonides, declares, while discussing Maimonides' view on women that Maimonides was largely operating within an Islamic framework of law, but that modern trends in Jewish law have taken the more liberal elements of Maimonides while discarding some of the particular claims troublesome to modern sensibilities:

In the modern period, the greatest Talmudist since the Gaon of Vilna, the Gaon Rabbi Saul (GeRaSH) Lieberman, an admirer of Maimonides, encouraged women to study Talmud and admitted them into his Talmud classes. (Maimonides: the Life and World of One of Civilization's Greatest Minds pg. 336.)

Rabbi Lieberman, who headed JTS' Talmud department and was the leading rabbinic figure of Conservative Judaism for much of the twentieth century, is certainly on my list of great rabbis and for more deserving of titles than just about any of the Haredi rabbis that I care to think of. For one thing Rabbi Lieberman was a legitimate scholar, whose published work truly did advance the field of Talmudic study, particularly in regards to the Jerusalem Talmud. Still I wonder what Rabbi Elijah of Vilna would think of the comparison.

Rabbi Dovid Schwartz Responds


I emailed Rabbi Dovid Schwartz some questions regarding his letter to the Yated. Rabbi Schwartz was kind enough to respond.


Haredim are often in the habit of using the failures of Spanish Jewry in 1391 and 1492 to discredit Maimonidean rationalism. Why is this same logic not used to discredit Eastern European Jewry?

Apples and oranges. The primary failure of Spanish Jewry in  1492 was the advent of the conversos and their inability to flee (often equating to Mesiras Nefesh with sinking ships and communicable disease) rather than convert.  There's was a test of the willingness to die al kiddush Hashem.  The Holocaust and it's precursors OTOH were about genocidal racism.  They may have been outgrowths of a clash of faiths/civilizations but by the time Jews began defecting en masse from observance it a. was not to embrace Christianity and b. did not improve their coping or survival rates.

Could not your defense of Eastern European Jews be also used to apologize for Modern Orthodox Jews and even for Reform and Conservative Jews?

Which MOs , conservative and reform do you mean?  For those in Europe, particularly Eastern Europe it might (while there is still a big difference between defecting to the Bund or joining a Reform Temple).  But for those in America I don't see how it could as one can't begin to compare the poverty or discrimination levels of the old and new worlds.  TTBOMK Modern Orthodoxy is a distinctly American post-war phenomenon and had no models in interbellum EE Jewry.

How do we measure spirituality? Does this not simply turn into a defense of any group we wish to offer a positive outlook for?

While by it's non-material nature spirituality is not subject to the kind of qualitative analysis one accomplishes with a good centrifuge there are some relatively objective and quasi-empirical yardsticks.  The "efficiency" argument that I made in the letter i.e. that a smaller volume  Yeshiva World produced a higher number of higher quality Lamdanim and Talmiday Chachomim will not be denied by anyone familiar with both worlds.  If nothing else is convincing see the published works of the products of that world compared to the published works of our own.

But essentially I would not say that I can refute your assertion empirically.  What I can say is that if one believes in the truth of the "intangible" known as spirituality or kedushah at all then, like good art or music, it can be discerned and graded intuitively without resorting to metrics.  Which supreme justice famously opined "I can't write a legal definition for pornography but I know it when I see it?" [Justice Potter Stewart]    While I am certainly no world class expert I fancy myself qualified to voice some opinion on the relative tzidkus, chochmah, pikchus, lev tov and kedushah of the two Jewries.

How do we measure intellectual greatness between different generations particularly considering the major shift in pedagogy over the past few decades in regards to memory? Granted past generations, both Jewish and gentile, were superior in terms of memory. Memorization was a major part of traditional educational systems. We focus less today on memory because information is so easily accessible. In theory, at least, we are more devoted to developing analytical skills.

This point has some validity but more so in the secular sciences than in Torah scholarship in which vast bekius is indispensable. Yeshiva urban legend has it that Rav Chaim Brisker once bragged that his 15 year old Velevla (the eventual Brisker Rov) knew all of Shas Baal Peh. When the person hearing this boast remarked that he considers this insignificant and unbecoming for a son of the great Rav Chaim who would be a fitter son of his father it he excelled at severa and/or lomdus . Rav Chaim supposedly said that any sevara forwarded without complete awareness of all of Shas is by definition krum. Accessing a Talmud data base cannot replace this kind of internal, encyclopedic checks-and-balances on ones analytical skills.

More simply put we have the teaching of Chazal who said that divrei Torah aniyim hem b'mkomam v'ashirim hem m'mokom acher formalizing the symbiosis between bekius and sevara, between sinai v'oker Harim.

If you were put in charge of Artscroll what kind of changes would you make to the type of history books and biographies of gedolim they traditionally publish?

As I haven't read many it's hard to say.  But In general I feel that the culture of Godol hero worship today, while well-meaning, has backfired.  We have made such angels out of our gedolim that an impression of their being born rather than made prevails.  I think that this has nipped the career of many a late-blooming talmid chochom or tzadik in the bud.  Artscroll biographies in hand, the Yetzer Hora comes to such bochrim and claims "forget it.  You're too old already.  If you weren't a child prodigy, if you have already wasted many minutes of your childhood and adolescence then there is no way you will ever vaks ois to be another ______(fill in the blank with the name of a godol of your choosing)".  This is what I meant in my letter when I wrote that I found the surface honesty of the original article refreshing.  At least it wasn't another fluff-piece fairy-tale hagiography.  IMO these are not only untrue but they retard the growth of many a potential spiritual seeker.

Do you believe that we can build a stronger Judaism than that which existed in pre-Holocaust Europe? What would that stronger Judaism look like?

A.  Yes, but it will take a millennium and woe betide us if Moshiach isn't here by then.

B.  The shorthand answer?  Like that which existed in Lithuania and Poland before the war with all of the passion, self-sacrifice and intellectual ferment but with none of the disaffection, poverty and genocidal anti-Semitism.  However I'm not enough of a Sociologist to know if it's even possible to build one without the other.  As Nietzsche said "Whatever doesn't kill me only makes me stronger". (I referenced this maxim in my letter as well but did not attribute it for fear of scandalizing the readership.  They are probably furious that the editor left words such as Trotskyite and revisionist Zionist in!)

Learned Jewish Women in Sixteenth Century Italy


Renaissance Italy is usually a good place to look for precedents for liberal Jewish practices. In terms of Jewish education for women and women studying the Talmud Andree Aelion Brooks points out:

Shortly before Dona Gracia was born, a Talmud Torah for girls had opened in Rome; its women graduates emerged as poets, writers and patrons of the arts. A woman known as Pomona da Modena, living in Ferrara at the beginning of the century, was said to be as well versed in Talmud "as any man." Another member of Pomona's family, Fioretta, was constantly engaged in Hebrew and rabbinic learning. Others worked as scribes.

Then there was Bienvenida Abravanel, a niece of the famous Don Isaac Abravanel, the man who led the Jews out of Spain at the time of the Expulsion and later settled in Naples. Bienvenida was so smart and well educated that she became the tutor, and later advisor, to Leonora, daughter of the viceroy of Naples. When the Jews were expelled from Naples in 1530, it was Bienvenida who maneuvered through her court connections to have the order rescinded. After the death of Bienvenida's banker husband, Samuel, Bienvenida continued to run his banking business and use her wealth to ransom Jewish refugees captured by pirates. (Brooks, The Woman who Defied Kings pg. 27)

 
It should be noted that Isaac Abarbanel believed, in some sense, that women did not have souls and that only men possessed them. Having elite learned women does not mean that women as a group were educated. People who are wealthy and clearly intelligent are going to be allowed a fair degree of eccentric behavior no matter what society they live in and are going to be able to get away with breaking certain social taboos.

Fifteenth World Congress of Jewish Studies: Hebrew Bibliography in Early Modern Europe

Adam ShearReuchlin and the Categorization of Jewish Literature circa 1500

How did Early Modern Jews organize books? How did such categories affect how the books were treated? Such a study should reveal something about the mental framework of those who used them. One place to look are lists of books whether Jewish nor non-Jewish. These lists, though, are not divided by categories. Historians are left using modern categories. Using our modern categories can obscure the relationship between these books. All historical research involves translation, but there is still a need to understand things as people at the time understood them. The Christian Hebraist Johannes Reuchlin responded to Johannes Pfefferkorn, a convert from Judaism, who had told the emperor that Jewish literature contained damaging material to Christians. Reuchlin defended the Talmud and Jewish rights. According to Reuchlin, Jews had legal protection and that furthermore their works benefited Christians. Reuchlin offers the earliest bibliographical scheme for Jewish books, going from most authoritative to least authoritative.

Holy Scripture – This carries the highest authority.

Talmud – Reuchlin makes no mention of the Mishnah nor does mention the Oral Law. He simply views the Talmud as exegesis on the Bible. As a Christian he was not about to lend any extra authority to the Talmud as having any basis in a tradition. This stance, though, also helps when dealing with anti-Christian statements. Reuchlin could argue that such statements were not intrinsic to Judaism.

Kabbalah - This was not something that Pfefferkorn or the Cologne theologians were familiar with. This had more to do with Reuchlin’s interests.

Commentaries – These, Reuchlin points out, are not binding, like the Talmud.

Midrash and Sermons – Reuchlin removes Midrash as a category of series of authority and places it on the same level of medieval sermons. There is no mention of Jewish liturgy.

Philosophy

Poetry, fables – These are deemed by Reuchlin as whimsical. Even the Jews, he claims, do not take them seriously. Reuchlin places the Nizzahon and Toldot Yeshu in this category. He even makes the claim that the Jews forbid these books themselves. Reuchlin may have been a naive sap but a very canny lawyer.

As Yaacov Deutsch argues, this is a period in which Christians, particularly converts, begin to offer descriptions of what Jews do. There is a parallel to the Barcelona debate of 1263. Reuchlin seems to engage in both sides of the Barcelona Debate. Like Nachmonides he tried to limit authority of midrashic literature. On the other hand he wished to give a Christian interpretation of Jewish texts.

Stephen G. BurnettJean Plantavit de la Pause’s Bibliotheca Rabbinica (1645) and Seventeenth - Century Jewish Bibliography

The Christian Hebraist Jean Plantavit de la Pause’s (1576 – 1651) bibliography of Jewish books, Biblia Rabbinica, is often criticized for repeating the errors of Johannes Buxtorf and adding his own. Plantavit is still valuable as an example of this period where knowledge of Judaism growing because of converts and because of more Judaic libraries. Plantavit lead a dramatic life with two theological careers. He was born into a Hugonaut family and trained as a Protestant theologian. He converted to Catholicism after he already had a degree in theology. Interested in Hebrew, Plantavit studied with Leone Modena. Modena encouraged him to start his own Hebrew library. Modena may have done this out of self interest as he was a book seller. Plantavit also studied under Domenico Gerosolimitano, the converted Jew who served as the chief censor for the Catholic Church. Biblia Rabbinica was intended to replace Buxtorf’s work. Such a bibliography served a Catholic polemical purposes. In a post Index world, Catholics needed a guide as to what books were permitted to read and quote. Plantavit owned over one hundred and eighty books out of eight hundred books he listed. He also owned a copy of the Jerusalem Talmud, even though he does not list it. This book was banned; Plantavit was more interested in telling other people what to read than in following his own advice. While Plantavit had Buxtorf outnumbered by two to one, the younger Johannes Buxtorf put out an updated version of his father’s book five years earlier. This had over a thousand Hebrew books, making Plantavit’s book outdated from the start. Between the two of them, Buxtorf and Plantavit only listed about a quarter of the Hebrew books printed.

War and Peace: My First Conference Presentation and My Weekend at Purdue (Part II)

The second paper was “The Moral Significance of Recognizing Violence in Pogge’s Borrowing and Resource Privileges,” presented by Mark Balawender of Michigan State University. Thomas Pogge attacks borrowing and resource privileges, arguing that the developed world acts as an enabler to authoritarian governments as they borrow money and cause economic harm to their people. This process of borrowing money in exchange for resource privileges allows corrupt third world governments sell out their own countries. There is not normative standard to judge the legitimacy of governments. This allows authoritarian governments to seize power and gain money quickly even though this harms the population. How does one deal with this from the perspective of liberalism which allows economic transactions that only incidentally cause harm to other people?

A useful analogy is the case of two parallel paths one higher up than the other where the rocks from the higher path can cause harm to those on the lower half. Such a situation is okay where the population freely chooses which path to take. What happens when you have a case where the path one chooses is dependent on one’s social or economic status? This would create a different moral situation. Thus such instruments of global Capitalism as lending money to corrupt third world regimes in exchange for resources should be classified as forms of violence and should be viewed as wrong within the parameters of liberalism.

I found this presentation amusing mainly because it reminded me so much of Talmudic dialectics. As a good traditional liberal I oppose the aiding and abetting of authoritarian regimes. As a believer in free markets, though, I have the ultimate weapon against such regimes, Capitalism. Under free market conditions it is not in my interest to support authoritarian regimes even when control over their natural resources. Such regimes are likely to fall and the new regime is unlikely to respect its predecessor’s agreement, particularly if they are able to make the case to the world that this was a bargain made between thieves, designed to impoverish the country. I raised this issue with Balawender and he responded that Pogge had used a similar argument.

The final presentation of the first session Nathan Stout of Western Michigan University, “The Torture Memo: A Philosophical Critique” Prof. John Yoo’s Torture Memo, on behalf of the Bush administration, allowed for extreme interrogation tactics. Yoo defines Al Qaida members both as enemy combatants and as unlawful combatants. He assumes that 9/11 was a declaration of war on the part of Al Qaida and therefore the United States entered a formal war with Al Qaida no different than a war with a established state. This makes what happens next to fall under the military; Al Qaida fighters are military combatants. On the flip side, since Al Qaida does not keep to the established protocols of war, they are unlawful combatants, no different than spies. Congress does not have the authority to interfere with the President’s handling of unlawful combatants and the President is free to do with them as he wishes. How does one go about defining combatants and unlawful combatants? We assume that enemy combatants lose their rights to life and liberty because they choose to participate in war. This is in keeping with Just War theory. An unlawful combatant wishes to fight while maintaining the protections of a non combatant; he therefore loses the rights of lawful combatants. Yoo’s model would require one to assume that Al Qaida soldiers had a right to fight to begin with. Yoo, though, rejects the notion that Al Qaida is in any way a legitimate political entity. This being the case one should not be able to say that the United States is at war with Al Qaida.

I have not studied Yoo’s arguments, though the argument he makes seems to be very similar to the one that I made in a debate on Atheist Ethicist. I argued that the Al Qaida fighters held on Guantanamo Bay get the worst of both situations. As out of uniform combatants they have no legal rights. As prisoners captured during combat they do not need to be tried. The challenge being raised against Yoo seems to have a very simple solution, accept that Al Qaida is a political entity and should be treated as a state. I raised the scenario with Stout where Al Qaida would have acted “legally.” Al Qaida issues a formal declaration of war on the morning of 9/11 before they hijacked the plans. Uniformed Al Qaida soldiers get past security and hijack civilian airliners. After somehow getting all civilians off the plans they then crashed the planes into military targets such as the Pentagon. America declares war against Al Qaida and invades Afghanistan. Uniformed Al Qaida fighters clash with American forces out in the open, away from civilians, and are captured. I would have no problem with saying that Al Qaida prisoners should, under such circumstances, be treated with full legal rights as if they were from England, France or Canada and protected from torture. Since this is not the case, I have no problem in stripping Al Qaida fighters of their legal rights and handing a blank check to our government to torture them.

Historians in the Philosophy Department: A Response (Part IV)

I would like to say a few words about the issue of post-modernism and why I object to it.





This is a picture of me at the Museum of Modern Art in Los Angeles (MoMA). I am standing next to one of the exhibitions, which consisted of the New York Daily News covered in bird droppings. Now I am not opposed to the message of the work, namely that the Daily News is a load of bird droppings; I agree. I also agree that this work raises a valuable issue in that it challenges us to consider the nature of art; what is the difference between a work of art such as the Mona Lisa and a page of newspaper covered in bird droppings? The problem with this is that, while this is a great point, it is the enemy’s point. The conclusion to be drawn from being unable to distinguish between the Mona Lisa and a page of newspaper covered in bird droppings is not that the page of newspaper with bird droppings should go up in a museum and that we should have a museum of modern art devoted to such work but on the contrary, that we should not bother sticking up the Mona Lisa in a museum and that we should send the Mona Lisa and all the rest of the works housed in the Louvre in the trash bin along with the page of newspaper with bird droppings, thus allowing us to use the Louvre for something that actually benefits people.

At the Barcelona debate in 1263, Nachmonides was forced to respond to Christian charges that the Talmud confirms the truth of Christianity. At the beginning of the debate Nachmonides admitted to being puzzled by this; how it could be that the rabbis of the Talmud, living centuries after Jesus, could believe in Jesus and still reject Christianity? It seemed to be a matter of course for Nachmonides that, if the rabbis of the Talmud believed that Jesus was the Messiah and the Son of God, they would have done the intellectually honest thing and ceased practicing Judaism and converted to Christianity. Obviously, Nachmonides never met a post-modernist.

Post-modernism thrives on people undermining the legitimacy of their own work and still having the chutzpah to ask that society fund them in their endeavors. It is called deconstruction. If post-modernists really believed in what they were doing and were intellectually honest they would admit that the entire humanities field, including their own particular slice, was worthless and they would pack up their things and leave academia. Frank Donoghue wishes to blame our business-oriented society for killing off the humanities and he is right. What Donoghue does not ask is why the humanities have so utterly failed to defend themselves and make their case to society in the face of the business suits and number crunchers. For that, you need Allan Bloom. Bloom, in his Closing of the American Mind, blames the modern left, with its worship of cultural relativism and its deconstruction of values, for bringing about a situation where even the humanities have no value. If all values are relative and there are no ultimate questions let alone ultimate answers then why should someone spend years of their lives studying Plato and Aristotle; why not just go to law school and make as much money as you can. Bloom was a tenured professor at the University of Chicago so his main concern was attracting students. As a graduate student, who made the choice to study history instead of going pursuing law school, my concern is getting a job at the end of the day. If the humanities have no value then why should a university bother to make the investment in hiring me?

I have a suggestion for all post-modernists out there. If you do not believe that the humanities have intrinsic value and if you do not even believe in ultimate questions and in ultimate truths then please have the intellectual honesty to leave the university system; pack your bags and get a job in the real world. There are few enough jobs in the humanities as it is; the least you can do is leave those jobs to those who actually believe in what they are doing.

Historians in the Philosophy Department: A Response (Part III)

I see the field of history as consisting of three parts. First, there is the collection and editing of primary source material. Then there is the analysis of the primary source material, creating secondary source material, in order to see what directions the primary sources point. Finally, there is the creation of a narrative, which puts together the conclusions of the secondary sources into some consensus. The history familiar to the general public is really this last stage. For the most part, academic historians devote themselves to the second stage and it is this stage that forms the real heart and soul of the study of history. It has actually very little to do with narrative.

The issue of narrative is a sore spot for historians. It is the part of history that is the furthest from objective truth and the closest to personal opinion. If historians cannot be scientists they still wish to be better than artists or literature professionals. Again, considering the tight job market, this is not an academic question; real careers are on the line. I recommend Hayden White’s Metahistory, where he subversively treats history as a form of literature. What is important to note about White is that he only deals with issues of historical narrative. I suspect that most historians would gladly do away with narrative as at best a distraction and at worst an illusion that undermines "real" history.

Narrative remains in place largely because it is necessary to make one's work relevant, first to fellow historians, then to scholars in the humanities and finally to the general public at large. One of the ways that this is done is by showing how one’s work fits into someone else’s narrative. For example, Dr. Goldish has a particular expertise in early modern Jewish thought and how it fits in with what we see with European Christians. He wrote his dissertation on Isaac Newton and his use of rabbinic sources. Similarly, his recent book, Sabbatean Prophets takes sixteenth and early seventeenth century Jews and shows how it is similar to, for example, Phyllis Mack’s discussion of mid-seventeenth century Quaker women in England. I see almost a caricature of this type of thinking at conferences where presenters rush to list off names of theorists just to force some greater “context.” With Dr. Goldish it never sounds forced; this speaks both to his talents as a historian and as a writer.

Working with Dr. Goldish has been very beneficial to me because of this and has given me a far greater range as a historian. I came to Ohio State with very strong skills in terms of textual analysis. I grew up studying Talmud, plus I have Asperger syndrome so I am naturally very comfortable with texts. (I was not actually officially diagnosed with Asperger syndrome until after I came to Ohio State.) When I came Dr. Goldish told me point blank that the other students do not have my text skills; he did this in order to soften the culture shock for me coming to a secular university and, for the first time in my life, having to deal, on a daily basis, with people not trained on Talmud. What Dr. Goldish then went to work on me was narrative, telling a larger story.

At the end of the day, narrative does have an important role to play in history. If narrative is necessary in order to show some higher relevancy and get a job it is because it is important to do something that is actually relevant. Kenneth Miller has a line: “biology without evolution is stamp collecting.” Evolution serves to take all the bits of information that we have about organic life and puts it together in one coherent “narrative.” Similarly with history; the Civil War buff, like my adolescent self, who can throw out lots of random facts about the Civil War, is not engaging in history. First, he needs to be able to analyze primary and secondary source material through the lens of the historical method. Next, he needs to be able to put everything together into some narrative. Without this, all that we have is a cute factoid machine that is of no practical use to anyone.

“Scripturalization of Rashi’s Torah Commentary in Late Medieval and Early Modern Times”

Even though Rashi was not widely accepted in Spain initially and was not even mentioned by Ibn Daud, by the thirteenth century Rashi had a achieved an almost canonical status. We see a move to treat Rashi like the Talmud, a flawless source that most be analyzed line by line. Nachmonides, even though he himself criticized Rashi, played a large role in this by putting Rashi on the map as a major figure to contend with. This veneration of Rashi can be seen in both the rationalist and Kabbalistic streams of Jewish thought. Moshe ibn Gabbi attacks his philosophical opponents by labeling them as little foxes who attack Rashi. Sefer Hameshiv talks about Rashi having prophetic power and claims that his commentary was written with the help of an angel. On the flip side you have people like Isaac Campanton who, in his Darachi HaTalmud, states that the process of iyyun, in depth textual analysis, applies not just to the Talmud but to Rashi and Nachmonides as well. Two of Campanton’s students, Isaac de Leon and Isaac Aboab, wrote super commentaries on Rashi.

(Isaac Abarbanel’s teacher, Joseph Hayyun, was also a student of Campanton. It is interesting to note that Abarbanel does attack Rashi, though Rashi is certainly a key source for Abarbanel. I would see this as another example of how Abarbanel fits into an Nachmonidean line of Jewish thought.

Lawee is one of the world’s foremost experts on Abarbanel. I was even considering applying to York in order to work with him. We spoke on the phone and came to two conclusions; one, we got along very well and, two, York would not be a good fit for me. So this was actually the first time I ever met Lawee face to face. And I most say it was an honor.)

“Leon Modena as Reader and as Read”

There is often a tension between the correct and the plurality of readings as in the case of Leon Modena’s understanding of the Zohar. Modena’s Ari Nahom has traditionally been read as an attack on the Zohar. Modena attacked Kabbalistic theology as being akin to Christianity. He also denied the traditional Rashbi authorship and placing Moshe de Leon as its author. In other places in his writing, Modena laments on how easily available Kabbalistic texts have become and that anyone can purchase them and pretend to be a scholar. This has been Modena’s reputation down to modern times. In truth though, there is actually more to Modena. He praised the Zohar for its language and style. He even used it in his sermons. Modena had no objection to the Zohar as long it was simply treated as a medieval commentary on the Bible and not as a canonical text on Jewish theology and law.

Modena was directly targeted by a member of the Luzzatto circle in his defense of the Zohar. This shows that Ari Nahom was influential and did circulate even though it was not printed until the nineteenth century. Contrary to the Elizabeth Eisenstein model, print did not simply eliminate manuscripts. An active manuscript culture continued to exist for centuries.

“A New Guide? The ‘Modern Maimonides’ Motif in the Maskilic Reception of Spinoza”

Who was the first modern Jew, Benedict Spinoza or Moses Mendelssohn? This question assumes that modern equals secular and that these figures can be viewed as secular. Even with Spinoza that is not so simple. In a sense it is justifiable to talk about Spinoza as the first modern Jew in that he filled that script and served as a usable past for many maskilim. In Maskilic literature Spinoza is often placed alongside Maimonides. This is strange since Spinoza attacked Maimonides. Though one could make the case that Spinoza started off as a Maimonidean and that Maimonides continued to play a significant role, in some sense, in his thought. Maimonides is important for Spinoza because he played an important role in how Spinoza was read by Maskilim. The idea of Maimonides acted as an interpretive framework for understanding Spinoza. Spinoza becomes a second coming of Maimonides.

“Who Asks the Question? Rashi’s Constructed and Constructing Readers”

Does Rashi serve to teach Bible or teach Midrash? Different early commentators took different approaches. This can actually be seen in the different manuscripts we have of Rashi’s commentary. We have examples of copyists who take away the line by line element of Rashi, removing Rashi’s commentary from its direct interaction with the biblical text. An example of this can be seen in the variant versions of Rashi’s explanation for the binding of Isaac. In some versions instead of Satan accusing Abraham, like in Genesis Rabbah, it is divine judgment. We also have texts that talk about God testing Abraham in order to perfect him; this takes the text in a very different direction than Genesis Rabbah.

General Exam III: Jewish History (Part IV)

[For the final part of the exam I was given two texts to analyze. One was from Jacob Marcus’ Jew in the Medieval World and the other was from Gershon Cohen’s translation of Ibn Daud’s Book of Tradition.]

Text #1: (Modena)
This text comes from Leon Modena’s autobiography, Hay’ye Yehudah; it deals with the printing of his Historia de gli riti hebraici and how he nearly ran afoul of the Inquisition over it. This text is a useful example of the complexities of Jewish-Christian relations in the early modern period, particularly within the context of the age of the printing press and the split between Catholicism and Protestantism.

Modena was someone in regular contact with Christians and engaged in friendly scholarly discussions with them. Historia was written at the behest, we believe, of Henry Wotten, the English ambassador to Venice, and was meant to be given to James I of England. In this book Modena gives an overview of Jewish laws and practices. In large respect he was responding to Johann Buxtorf the elder’s Synagoa Judaica. Modena wrote the Historia in 1616. He later, in 1635, gave this same book to a French-Christian Hebraist named Giacomo Gaffarel. Gaffarel then went and published the book on his own initiative. This created a problem for Modena in that there was material in the book that violated Catholic censorship policies. While the Historia was just a manuscript, one that was also written for a Protestants to boot, this was not a problem. Now, though, that Gaffarel had printed the book, Modena found himself to be an inadvertent promoter of “heresy.” The problem was quickly and painlessly solved. Modena explained the matter to the local inquisitor, who proved to be quite sympathetic and understanding. It turns out that even this was not necessary as Gaffarel did not publish the manuscript as is but, on his own initiative, removed the potentially objectionable material.
This story illustrates something about Catholic censorship. This whole incident happened only a few years after Galileo was put on trial for the Dialogues. Galileo’s real crime was not that he was a heliocentrist, but that he failed to adhere to the letter of the original ban on him writing on the issue and, more importantly, he managed to antagonize Pope Urban VIII. One could get away with a lot during the seventeenth century, inquisition censors or no inquisition censors, as long as one knew how to adhere to the letter of the letter of law and avoided antagonizing any of the wrong people. Publishing books was a political game and one was perfectly safe as long as they knew how to play the game. Galileo was not very adept at this game and suffered the consequences; Modena could play the game and was perfectly safe.

A word should be said here about Christian Hebraism; there are quite a few Christians in this story that are interested in Jews and Judaism and some of them are fairly knowledgeable. This had nothing to do with Christians thinking about converting to Judaism; though, as the case of Peter Spaeth illustrates, this did happen on occasion. Rather this early modern Christian Hebraism was rooted in the search for the prisca theologia, the original theology, which lay behind much of early modern thought. The premise was that humanity had fallen away from the truths of antiquity and that these sources could be recovered by a close examination of the sources. One of the major manifestations of this was the interest in “magical” texts such as the Hermetic corpus, thought to date from the time of Moses, and the Zohar. Another manifestation was a renewed emphasis on the bible and reading it outside of the shadow of the Vulgate and the medieval Catholic tradition. Protestantism was a product of this movement. Protestants in particular were interested, in this period, in forming contacts with Jews and Jewish sources because they believed that, while the Jews may have corrupted their own sources, a critical analysis, in light of Christian truths, of such material would allow one to uncover the original true “Christian” religion behind it.

This whole incident is a good illustration of how interrelated Jewish history is with the happenings within the general society. Jews in Europe did not live in a different world from Christians. The printing press, the Catholic Church’s post-Tridentine censorship, the struggle with Protestantism affected someone like Leon Modena just as it affected Galileo.

Text #2: (Ibn Daud)

This text in Ibn Daud’s Book of Tradition, deals with the story of the four captives. According to this story four rabbis were captured by pirates and ransomed respectively by the communities of Fostat, Qairawan and Cordova. These rabbis stayed in these given communities and set up communities. Ibn Daud uses this story to explain how it came to pass that the authority possessed by the Babylonian Gaonate passed to Spain. This story is useful, though not in its most obvious sense. The story is clearly a legend and cannot be accepted as historical fact. That being said this story is an excellent example of the telling and use of legends. As such, while this story tells us nothing of use about the origins of the Spanish Jewish community, it is very useful in understanding Ibn Daud and by extension Andalusian Jewry.

The story of the four captives serves as a convenient foundation story. It gives a clear cut, dramatic story that points to a given conclusion. It clearly fits into the overarching narrative of the Book of Tradition. The main purpose of the Book of Tradition is the defense of the rabbinic tradition, particularly in the face of Karaite critic, and the establishment of Andalusia as the center of Jewish life and Torah authority. As such the story is just too convenient to be taken at face value as a historical event.

Within the story itself there is micro narrative that is highly suspicious. We are told that that the captain wanted to violate the wife of one of the captives, R. Moses. She asks him if she would be allowed to throw herself overboard to drown; would such an action bar her from the future resurrection of the dead. R. Moses responds by quoting the verse: “I will bring them back from Bashan; I will bring them back from the depths of the sea.” The wife accepted this and drowned herself. The problem with this story is that it is lifted straight out of the Talmud. In the Talmud the story is that there are two boats sailing to Rome with Jewish captives, one with four hundred boys and another with four hundred girls. Fearing for their chastity, the girls ask the boys if they would be forfeiting their place in the future resurrection by jumping overboard. The boys reply by the same verse. The girls follow this advice and jump. The boys then follow the example themselves and also commit martyrdom. So here in the four captives story we have the same scenario, woman on a boat with her virtue threatened, with the exact same conversation and the exact same verse quoted. What is one supposed to believe; that R. Moses and his wife played out the Talmudic story, apparently unaware of the precedent, or someone lifted the story from the Talmud and used it for the four captives story.

The ending of the whole narrative is also simply too convenient and too much to type to be believed. We are told that R. Moses and R. Hanok arrive in Cordova. They go to the central synagogue and sit in the back; everyone just assumes they are simple beggars. While they are sitting there, the leading rabbi, R. Nathan the Pious, is unable to give the correct explanation in a matter of law. R. Moses and Hanok come forward, deus ex machina, and solve the problem. R. Nathan the Pious is so amazed by these two scholars that he steps down and acknowledges their authority. This is the sort of thing that only happens in legends. In real life, revolutions in authority do not happen overnight; the opposition fights with every last breath and goes to its grave kicking, screaming and denouncing the interlopers, who stole what was rightfully theirs.

A Proper Jewish Education

David ibn Yahya (1465-1543) was a Spanish exile who went to Naples and served as a Talmud teacher. In addition to Talmud, he also taught a variety of other topics. He offered the following description of the curriculum he taught.

In addition, I studied with them a daily chapter of Talmud, and other subjects such as grammar and poetics and logic and [al-Ghazali’s] Intentions of the Philosophers and [Jediah Bedersi’s] Book of the Examination of the World. And on the Shabbaths [I would] sometimes teach [Judah ha-Levi’s] Kuzari and at times [Maimonides’] Guide for the Perplexed. And all this, even though I was only required to teach one Talmudic lesson every morning, in order that they should know what is required, and to rule on what they ask me each day. But in order to fulfil(l) what is required of me by heaven and by the people, I went beyond my [required] quota, with great effort and painful labor. Ibn Yahya viewed the teaching of philosophy as a requirement from heaven, alongside the teaching of Talmud. Not only that but the philosophers in his curriculum included not only Jewish philosophers like Judah ha-Levi, Maimonides and Jediah Bedersi, but also the Muslim philosopher al-Ghazali. Ibn Yahya’s use of al-Ghazali and his use of the Intentions of the Philosophers in particular was not an anomaly with the Spanish Jewish tradition; he formed a basic part of the Jewish philosophical educational system. The Story of Kamtza and Bar Kamtza: A Tisha B’Av Lesson on the Historical Method

Since today is the fast day of Tisha B’Av, the ninth day of the month of Av, when Jews mourn the destruction of the two temples and a host of other tragedies, I decided to offer a brief lesson in the historical method using the destruction of the second temple. To explain why the temple was destroyed the Talmud tells the following story of Kamtz and Bar Kamtza.

There was a man who had a friend named Kamtza and an enemy named Bar Kamtza. This man made a feast and told his servant to bring Kamtza. The servant made a mistake and brought Bar Kamtza. The man found Bar Kamtza sitting at the feast and asked him to leave. Bar Kamtza offered to pay for his meal. The man refused. Bar Kamtza offered to pay for half of the entire feast, but the man still refused. Bar Kamtza finally offered to pay for the entire feast. The men would not even consent to this and threw Bar Kamtza out. Bar Kamtza decided that since the Rabbis were sitting there and did not protest they must have supported it. He decided to take revenge by libeling them before Ceasar. He went and told Caesar that the Jews were rebelling. Caesar asked him how he knew this. Bar Kamtza suggested that he send the Jews a sacrifice and see if they bring it. Caesar sent, in Bar Kamtza’s hands, a calf. Bar Kamtza took a needle and pierced the calf’s lip, thus making a blemish. Upon examining the calf, rabbis were uncertain as to how to respond. Some wanted to bring it in order to preserve peace with Rome. Rabbi Zachariah ben Avkulos, though, argued against this saying that people would come to think that it is permissible to bring blemished animals. The rabbis then suggested that they kill Bar Kamtza in order to silence him. Rabbi Zachariah ben Avkulos would not allow this either lest people think that bringing blemished animals carries the death penalty. The sacrifice was not brought and because of this Rome attacked Judea and destroyed the temple. (See Talmud Bavli Gittin 55b-56a.)

As a historian I am required to follow the historical method of examining texts. Amongst many other things, this method requires that one privilege texts written close to a given historical event and treat texts written long afterwards with extreme caution. Closely connected to this is the notion that written texts are to be privileged over oral traditions. The rule of thumb when dealing with oral traditions is that they have a shelf life of seventy years, beyond that they become legends. Even more important than what texts you read, is how you read them. Amongst other things, the historian needs to have a good sense as to how a literary narrative is likely to sound and how it differs from a historical narrative. For example, having a war break out because the queen of one country fell in love with the prince of another country makes for an exciting romantic story, but does not confirm very well to real life experience. For this reason Herodotus, who was willing to accept a lot of strange claims, thought the Homer’s explanation as to why the Trojan War started, Helen of Sparta running off with Paris of Troy, was unlikely.

This is not to say that texts written close to the event are true and those written later are false. I do not claim that accurate oral traditions cannot be transmitted over hundreds of years. Also, I readily admit that truth is often stranger than fiction and stories that sound like fiction may in fact be true. All that this means is that, as a historian, one cannot grant much authority to such types of evidence. As a former teacher of mine once said: history is not about the search for truth, it is about verifiability. One can think of history as intellectual game that we play in which we follow the historical method of analyzing evidence, mainly texts, and see what sorts of directions this evidence points to. Whether or not what comes out is in some objective sense the Truth, is a separate issue that has nothing to do with history; let philosophers and theologians worry about such things.

I make no claim as to whether the story of Kamtza and Bar Kamtza actually happened or not. The historical method, though, does not allow me to give it much credence. The Talmud was written hundreds of years after the destruction of the Temple. Even more damning is the fact that this story has the ring of a fable to it. A man has a friend and an enemy whose names are almost identical and accidently invites the enemy instead of the friend. This enemy offers to pay the man a fortune in order to let him stay, but the man hates him so much that he refuses. This enemy becomes so bitter that he decides to take revenge against his entire people. To do this he travels from Judea to Rome, no small feat in the first century, and gets an audience with Caesar, also no small feat. Caesar, having nothing better to do than to listen to the ravings of a malcontent and conduct meaningless tests to discern the loyalty of a small province in the Middle East, decides to go along with what this man suggests. The plot works perfectly. The rabbis do not bring the sacrifice and Caesar, having nothing better to do with his legions, decides to launch a full scale invasion. A bunch of people decide to go to war and no one bothers to sit down, talk things over and negotiate. Is all of this quite possible? Certainly. But what does this story sound like? Does it sound like a real historical event or does it sound like the story that people, hundreds of years later, would tell about a historical event, dramatic with a nice moral lesson attached to it? As a historian, one must go with the later.

This has important implications as to how one looks at the history books put out by Haredi publishing houses such as Artscroll and Feldheim. When authors of Haredi history books report stories found in rabbinic literature as historical fact, such as the story of Kamtza and Bar Kamtza, they are not simply offering their own interpretation of history, to be put alongside academic history as a legitimate alternative. They are not following the historical method. As such what they write is not history and these authors cannot be viewed as historians.
